Because Vigil’s services may involve both ordinary business communications and simulated cybersecurity communications, this Email Disclaimer is intended to clarify how recipients should treat communications that appear to come from Vigil, its platform, its personnel, or its systems.
This Email Disclaimer should be read together with Vigil’s Website Terms of Use, Privacy Policy, Cookie Policy, End User Licence Agreement and SaaS Terms and Conditions ("EULA"), and any applicable customer agreement or Data Processing Agreement.
Emails and electronic communications sent by Vigil may contain confidential information, personal information, security-related content, legal notices, customer-specific materials, platform-generated communications, or simulation-related content. Recipients should review such communications carefully and take appropriate steps to verify any communication that appears unusual, unexpected, or security-sensitive.
If you receive a communication that appears to be from Vigil and you are uncertain whether it is genuine, simulated, or suspicious, you should avoid clicking links, opening attachments, submitting credentials, making payments, or taking other action until you have verified the communication through an appropriate trusted channel.
CONFIDENTIALITY AND INTENDED RECIPIENT

SECURITY, LINKS, AND ATTACHMENTS
Emails and electronic communications may be vulnerable to interception, alteration, delay, corruption, unauthorised access, malware, phishing, spoofing, and other cybersecurity risks. Vigil takes reasonable steps to maintain the security of its communications and systems, but cannot guarantee that any email, attachment, link, or electronic communication will be secure, error-free, virus-free, uninterrupted, or free from malicious interference.
Recipients should exercise caution before opening attachments, clicking links, downloading files, scanning QR codes, providing credentials, making payments, transferring funds, or taking any action in response to an email or electronic communication that appears unusual, unexpected, urgent, or suspicious.
Vigil will not be liable for any loss, damage, claim, cost, or expense arising from the transmission, receipt, use, delay, interception, corruption, or unauthorised alteration of any email or electronic communication, except to the extent such liability cannot be excluded under applicable law.

SIMULATION COMMUNICATIONS
Vigil operates a cybersecurity awareness and human risk management platform that may send simulated communications on behalf of subscribing customer organisations. These simulated communications may include simulated phishing emails, SMS-style messages, QR code prompts, voice-cloned calls, deepfake video communications, links, attachments, login prompts, or other social engineering scenarios designed to test and train employees or authorised personnel.
A communication that appears to come from Vigil, Vigil’s platform, a customer organisation, an executive, a colleague, or another trusted source may form part of a legitimate security awareness simulation conducted through the Vigil platform. Not all such communications are ordinary business communications from Vigil.
If you receive a communication and are unsure whether it is genuine, simulated, or suspicious, you should follow your organisation’s internal cybersecurity reporting process and verify the communication through an approved internal channel before taking action. You should not submit credentials, provide confidential information, approve payments, transfer funds, download files, or click links unless you are satisfied that the communication is legitimate and authorised.
Vigil conducts simulations on behalf of and at the direction of its subscribing customer organisations. The relevant customer organisation is responsible for ensuring that all required employee notices, workplace policies, consents, approvals, and lawful bases are in place before any simulation is deployed, including compliance with all applicable telecommunications, surveillance, workplace, employment, privacy, data protection, and electronic communications laws.
Nothing in this Email Disclaimer should be read as confirming or denying that any specific communication is a simulation, as doing so may compromise the effectiveness, security, and integrity of the relevant training exercise.
NO CONTRACT FORMATION OR BINDING COMMITMENT
Unless expressly stated otherwise in a written agreement signed or accepted by an authorised representative of Vigil, no email or electronic communication from Vigil creates, amends, waives, or terminates any contract, licence, subscription, service commitment, legal obligation, or commercial arrangement.
Any commercial proposal, pricing discussion, product description, subscription detail, implementation timeline, service description, or negotiation statement communicated by email is provided for discussion purposes only unless it is expressly incorporated into a formal agreement, order form, statement of work, customer agreement, or other binding document approved by Vigil.
Vigil is not bound by any error, omission, misstatement, unauthorised instruction, or unintended representation contained in an email or electronic communication, except to the extent expressly confirmed in a binding written agreement.
Nothing in any email or electronic communication should be treated as a waiver of Vigil’s rights, remedies, confidentiality protections, intellectual property rights, security controls, privacy rights, or contractual protections unless expressly stated in writing by an authorised representative of Vigil.
PRIVACY AND PERSONAL INFORMATION
Emails and electronic communications sent by or on behalf of Vigil may contain personal information, including names, business contact details, role information, customer account information, support details, security-related information, or information connected with platform use, enquiries, free trial registrations, or customer communications.
Vigil handles personal information in accordance with its Privacy Policy, the Privacy Act 1988 (Cth), and the Australian Privacy Principles. Where Vigil processes personal information on behalf of a subscribing customer organisation, Vigil does so in accordance with the applicable customer agreement, EULA, Privacy Policy, and any applicable Data Processing Agreement.
Recipients must not use, disclose, forward, copy, store, or otherwise process any personal information contained in a Vigil communication except for the purpose for which the communication was sent or where otherwise authorised by law.
If you believe you have received personal information in error, or if you have any privacy-related question regarding a communication from Vigil, you should notify Vigil promptly at operations@vigilsecurity.io and delete the communication where requested.

To the maximum extent permitted by applicable law, Vigil is not liable for any loss, damage, claim, cost, expense, or liability arising from or in connection with any email, attachment, link, file, simulated communication, or electronic message sent by or on behalf of Vigil, including any delay, non-delivery, interception, corruption, unauthorised access, technical failure, security incident, malware, phishing, spoofing, or mistaken transmission.
Vigil is also not liable for any action taken or not taken by a recipient in reliance on an email or electronic communication, except to the extent such liability cannot lawfully be excluded.
